Eligibility: This Proven Pure Pima Sweepstakes (“Sweepstakes”) is open to all natural persons who are legal residents of the 50 United States and District of Columbia who are at least 18 years old at time of entry. Void outside the USA, in Puerto Rico, the US Virgin Islands, and other United States territories and possessions. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
Sponsorship: The Sweepstakes sponsor is Himatsingka America, Inc. (“Sponsor”), located at 261 5th Ave #1605, New York, NY 10016. Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation, the immediate family members of such individuals, are not eligible to participate. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules.
Entry Period: This Sweepstakes begins on 08/23/18 at 12:01 AM EST and ends on 10/19/18 at 12:01PM EDT (“Entry Period”).
How to Enter: Follow Sponsor’s Instagram account as indicated and respond to any Sweepstakes offer posted by Sponsor on its Instagram page at https://www.instagram.com/pimacott/ by “Tagging” “Liking,” “Commenting” or otherwise responding in the manner and time period set forth in the offer (the "Entry Period”). The “Like,” or “Comment,” “Tag” or other required response must include all information required in the offer. Limit one (1) entry per unique Instagram account and per person per Sweepstakes. Entries generated by script, macro or other automated means are void, as are entries that are illegible, garbled, incomplete or that contain errors. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. No other entry method will be accepted. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook or Wamsutta. You understand you are providing your information to Sponsor and/or Administrator and not to Instagram or Facebook. All entries become the property of Sponsor and none will be acknowledged or returned.
Prize: Eight (8) Prizes will be awarded, each consisting of: One (1) Wamsutta Dream Zone1000-Thread-Count PimaCott Sheet Set, consisting of one (1) flat sheet, one (1)fitted sheet and two (2) pillowcases. Winner can specify size, selecting from Twin, Full, Queen or King sizes. Winner agrees to accept the Prize “as is” and entrants hereby acknowledge that neither Sponsor nor Administrator is in any manner responsible or liable for any warranty, representation, or guarantee relative to the Prize, including warranties provided exclusively by a prize supplier. Approximate retail value of the Prize is $139.99 – 249.99. Any difference between stated approximate retail value and actual value of Prize will not be awarded. Winner must provide requested size of sheet set within seventy two (72) hours after notification or prize will be declared invalid. Winner is solely responsible for any federal, state, and local taxes. LIMIT ONE PRIZE PER PERSON.
Winner Selection: Winner(s) will be selected in each Sweepstakes by random drawing at 12:00 PM (EDT) on the day indicated in the individual Instagram post from amongst all eligible entries received. Proof of transmission is not proof of receipt. Sponsor’s computer is the official time-keeping device for the Sweepstakes and determines the order of receipt of entries. The drawing will be conducted by Sponsor, whose decisions and interpretations on all matters relating to the Sweepstakes and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule, gained unfair advantage in the Sweepstakes, or obtained winner status using fraudulent means. If there is a dispute about the identity of an entrant, prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the Instagram account. If winner is found to be ineligible or not in compliance with Sweepstakes rules, winner will be disqualified and an alternate winner will be awarded the prize in a separate random drawing.
Winner Selection & Notification: The potential Winner(s) will be asked for an eligible email address by Instagram Direct Message and may be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity (where legal) form within seven (7) days of date of attempted notification. Inability of Sponsor to receive confirmation from winner by electronic message within seventy two (72) hours after selection, may result in disqualification of winner and an alternate winner may be selected in a random drawing at Sponsor’s discretion. Prize will be sent to winner by U.S. mail or other shipping method within fourteen (14)days after winner has been notified, accepted the prize, and provided color/sizing preferences. If prize is returned as undeliverable, then prize will be forfeited and another winner will be randomly drawn. Any winner later determined to be ineligible may be required to return his/her prize. Any taxes on prize are the responsibility of the winner.
No Warranties: Sponsor makes no warranties covering any of the prizes furnished as part of this Sweepstakes.
Odds: The odds of winning will depend on the number of eligible entries received, according to the eligibility requirements in the Sweepstakes.
WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITHOR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
General Terms: By entering this Sweepstakes, you promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. By participating, entrant (i) agrees to release and hold Sponsor, and its parent, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective directors, officers, employees and assigns (collectively, the "Released Parties"),harmless against any and all claims and liability arising in whole or in part, directly or indirectly, out of participation in the Sweepstakes or misuse, nonuse or use of any prize; (ii) waives all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to enter; and (iii) agrees to be bound by these Official Rules. Released Parties are not responsible for incomplete, lost, late, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries or referrals; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual's ability to participate. Sponsor reserves the right in its sole discretion, to cancel, suspend or modify the Sweepstakes, or to disqualify any implicated entrant(s), (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion.
Except where prohibited by law, by accepting prize, winner grants Sponsor a perpetual, worldwide, royalty-free license to use winner’s name, photograph, Instagram or Facebook user name, voice, and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world.
Privacy: Winners’ name and contact information will be used in order to contact winner for the purpose of fulfillment of prizes. Any information submitted to Sponsor, including all Entries will be governed by the terms of Sponsor’s User Agreement and Privacy Policy which can be found here: pimacott.com/privacy-policy
Governing Law: This Sweepstakes and the rights and obligations of the Sponsor and participants will be governed by and controlled by the laws of the State of New York, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of New York, County of New York. The parties consent to the jurisdiction of the state courts of New York and federal court located with such state and county with respect to any action, dispute, or other matter pertaining to or arising out of this Sweepstakes.
